RipTip (as defined below) provides this Privacy Policy, including, without limitation, any policies, rules and other terms that are expressly incorporated herein by reference (collectively, this “Privacy Policy”) to describe how we collect, use, and share the personal information collected through our websites, services, online, and any other media form, mobile application or mobile website related or connected thereto (collectively, the “Site”), and any content, information, functionality, products or services supplied by or on behalf of us through the Site (the Site and the services are herein referred to collectively as the “Services”). Please read this Privacy Policy carefully before using our Services.


All updates to this Privacy Policy are noted at the top of this page, with a date reference for your convenience. We reserve the right in our sole discretion to amend this Privacy Policy at any time. Your continued use of the Services after we make changes is deemed to be acceptance of those changes so, please check the policy periodically for updates. This Privacy Policy does not apply to websites, including without limitation, third-party websites linked to or incorporate into the Services, that are not owned and controlled by RipTip or that post different privacy policies or statements.


The Services are owned and operated by The RipTip Co. LLC, dba “RipTip” and “riptip” (“RipTip”, “we”, “us”, or “our”). Each user of the Site and/or the Services agrees that any dispute arising or relating thereto must and shall be addressed as between the applicable user and RipTip.


Privacy of Children

The Services are not intended for children or persons under the age of 16. Children or persons under the age of 16 are not allowed to use our Services. If we learn or have reason to suspect that a user is under age 16, we will promptly deactivate that user’s account and delete any personal information collected in connection therewith. We do NOT market or sell to ANY children under the age of 18 years old. For the avoidance of doubt, you must be of legal smoking age in your jurisdiction to view, use, and purchase from the Services.


What is Personal Information?

For purposes of this Privacy Policy, Personally Identifiable Information (“PII”) means information that identifies, relates to, describes, is capable of being associated with, or could be linked, directly, or indirectly, with a particular individual or household. PII does not include publicly available information. 




What personal information do we collect from the people that visit our blog, website or app?


Information you give us. When you contact us and communicate with us, place an order, or opt in by creating an account, registering for our loyalty program, utilize our Services, sign up to receive alerts or other information via email, text, or instant message, we may collect your first and last name, location information, email address, mailing address, phone number, credit card information, and other details you provide us to help you with your experience. We collect your personal information for the purposes described in this Privacy Policy.


Information We May Automatically Collect. We may automatically log information about you and your computer or mobile device when you access the Services. For example, when visiting our Site, we may log your computer operating system type, browser type, IP address, geolocation information, referring website from which you accessed the Site, pages you viewed on the Site, how long you spent on a page on the Site, access times and information about your use of and actions on our Site. We may collect device information about your mobile device. 


We may collect and process information about your actual location. We use various technologies to determine location, including IP address. Mobile applications may collect real-time information about the location of your device. If you do not want us to collect this information, you may decline our request or disable location services in your mobile device’s settings. However, opting out of the collection of location information will cause location-based features to be disabled and the online and/or mobile application may not function properly. 


We may collect analytics data, or use third-party analytics tools, to help us measure traffic and usage trends and to learn more about the demographics of our users. Such third-party service providers may use data collection tools to compile reports and provide us with other services in connection with the Services. We will not collect any location information that you do not volunteer or enable. We will delete any location information that you request us to delete.


Cookies. We may use cookies from time to time. Cookies are small files that a site or its service provider transfers to your computer’s hard drive through your browser (if you allow) that enables the site’s or service provider’s systems to recognize your browser and capture and remember certain information. They are also used to help us understand your preferences based on previous or current site activity. We also use cookies to help us compile aggregate data about Site traffic and Site interaction so that we can offer better Site experiences and tools in the future.


We may use cookies to:

  • Understand and save users’ preferences for future visits; and

  • Compile aggregate data about Site traffic and Site interactions in order to offer better Site experiences and tools in the future.

Pixel Tags and other similar technologies. Pixel tags (which also may be referred to as “web beacons” or “clear GIFs”) are small images that we (or our licensees or other third-party service providers) may use in connection with the Services so we may provide you with access to the Services, track our Services users’ actions and other similar purposes including to evaluate marketing campaigns. The type of information collected by Pixel tags may include the pages and links accessed by you as well as your IP address and other information about the device you used to access the Services.


Information Collected from Third Party Platforms. If you communicate with us through or mention us on a social media or other third-party platforms, we may collect information about you, such as your name, your username associated with that platform and any information or content you have permitted the platform to share with us. The platform provider’s privacy policy will apply to your interactions with the platform and its collection, use and sharing of your personal information, including when you interact with pages that we maintain on social media platforms. We will treat such personal information about you that we receive from such platforms as described in this Privacy Policy. You should check your privacy settings in your social media accounts to understand what information is sent to us through these services and how to restrict it.


Sensitive Information. With your consent, we may collect and process information about your actual location (geolocation data). You can deactivate access to your mobile device’s precise geolocation in your mobile device’s settings.


Does our Site Use Do Not Track Signals?

We honor do not track signals and do not track, plant cookies or use advertising when a Do Not Track (DNT) browser mechanism is in place.


Does our Site allow third-party behavioral tracking?

It's also important to note that we do not allow third-party behavioral tracking.


When do we collect information?

We collect information from you when you register, make a purchase, sign up for our newsletter, respond to a survey or marketing communication, surf the Services, enter information on the Site, or use certain other site features.

Artificial Intelligence. Our service providers and the third parties we work with may use artificial intelligence (“AI”) and machine learning technologies, including generative AI, to facilitate the processing of personal information described in this Privacy Policy.


Sharing or Disclosing Your Information 

Except as disclosed in this Privacy Policy, we do not disclose your personal information to any companies not part of RipTip or its parent, subsidiaries, affiliates, or related entities. In no event will we ever sell or rent any PII, except in the form of aggregate consumer information, as described below. We may, however, share your personal information as follows:

  • We may share personal information for legal, protection, and safety purposes.

  • We may share information to comply with laws or as permitted by laws.

  • We may share information to respond to lawful requests and legal processes.

  • We may share information with other companies and brands owned or controlled by RipTip, including our subsidiaries.

  • We may share information to protect the rights and property of RipTip, our agents, customers, and others. This includes enforcing our agreements, policies, and Terms and Conditions.

  • We may share information in an emergency. This includes protecting the safety of our employees and agents, our customers, or any other person.

  • We may share your personal information with vendors, service providers, payment processors, contractors and agents in connection with the performance of services on our behalf. These service providers are prohibited from using your information except as needed to perform our work or as required by law.

  • To process payments and manage any applicable loyalty program. Your personal information, including payment information is securely transmitted to and processed by Maverick Payments. Maverick Payments' privacy policy and security practices govern the handling of your payment information and your participation in any applicable loyalty program.   • We may share personal information when we do a business deal, or negotiate a business deal, involving the sale or transfer of all or a part of our business or assets. These deals can include any merger, financing, acquisition, or bankruptcy transaction or proceeding.

  • Social media platforms and networks such as Facebook, Instagram, Snapchat, X, TikTok, and Pinterest, that offer functionalities, plugins, widgets, or tools in connection with our Services (e.g., to log into an account, or to share inspiration, finds, purchases, and other content with your friends and followers on social media). If you choose to use these functionalities, plugins, widgets, or tools, certain information may be shared with or collected by those social media companies—for more information about what information is shared or collected, and how it is used, see the applicable social media company’s privacy policy.

  • We may share personal information for any other purpose disclosed by us when you provide the personal information.


We may also share your personal information with our employees, contractors, consultants, affiliates and other parties who require such information to assist us with managing our relationship with you, including trusted third parties that provide services to us or on our behalf. For example, we may share your personal information from time to time with third-party information technology, data processing, and call center service providers so that we may operate our business. 


Finally, we may also sell, rent, or share aggregate consumer information (i.e., anonymized summary data) with others for their own uses. Specifically, if you create an account or opt-in to any applicable loyalty program or contest, we may sell, rent or share certain aggregate consumer information that we compile using personal information collected about you and other users. This aggregate consumer information will never include your name, phone number, email address, or mailing address. We may sell, rent or share this aggregate consumer information with our partners and other companies for their own marketing, product development, research, or other uses. 


We do not sell, trade, or otherwise transfer to outside parties your personal information outside of the situations detailed above, unless you consent otherwise.


How do we protect your personal information?

We take the security of your personal information seriously and use reasonable electronic, personnel and physical measures to protect it from loss, theft, alteration or misuse. However, please be advised that even the best security measures cannot fully eliminate all risks. We cannot guarantee that only authorized persons will view your information. We are not responsible for circumvention of any privacy settings or security measures. Whenever we collect personal information, that information is encrypted and transmitted in a secure way. 


We are dedicated to protecting all personal information to the greatest extent possible. However, if you create an account, you are responsible for maintaining the confidentiality of your personal information by keeping your password confidential. You should change your password immediately if you believe someone has gained unauthorized access to it or your account. If you learn of any incident involving the loss of or unauthorized access to or disclosure of personal information that is in our custody, you should notify us immediately. 


Third-party links

Occasionally, at our discretion, we may include or offer third-party products or services on our website. These third-party sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these sites.


Google

Google's advertising requirements can be summed up by Google's Advertising Principles. They are put in place to provide a positive experience for users. 


We have not enabled Google AdSense on our Site, but we may do so in the future. California Privacy Rights

We encourage our customers who are California residents to review the “California Privacy Rights” section below which sets forth certain privacy rights specifically available to California residents.


This section contains disclosures required by the California Consumer Privacy Act (“CCPA”) (as amended and extended by California Privacy Rights Act) and applies only to “personal information” that is subject to the CCPA. According to CCPA, we agree to the following:

Updating Your Personal Information

It is important that the information contained in our records is both accurate and current. If your personal information happens to change during the course of our relationship, please keep us informed of such changes. We may request additional information to verify your identity.


In some circumstances we may not agree with your request to change your personal information such as when we cannot verify your request, when we need to complete a transaction, for certain business security practices, to comply with legal obligations, exercise legal claims or rights, or if the information is not considered personal information under state privacy laws. You also have the right to data portability and the right to restrict or object to our processing of personal data we have collected about you through the Services. In addition, you have the right to ask us not to process your personal data (or provide it to third parties to process) for marketing purposes or purposes materially different than for which it was originally collected or subsequently authorized by you. Terms and Conditions

Our Terms and Conditions are incorporated into and are a part of this policy. It is important that you read the Terms and Conditions, as where there is a conflict between this Privacy Policy and the Terms and Conditions, the Terms and Conditions shall prevail.


In order to be in line with Fair Information Practices we will take the following responsive action, should a data breach occur:

  • We will notify you via email within 7 business days; and

  • We also agree to the Individual Redress Principle which requires that individuals have the right to legally pursue enforceable rights against data collectors and processors who fail to adhere to the law. This principle requires not only that individuals have enforceable rights against data users, but also that individuals have recourse to courts or government agencies to investigate and/or prosecute non-compliance by data processors.


CAN SPAM Act

The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.


We collect your email address in order to:
